These guidelines govern vendor participation, operations, and event management for Night Bazaar. Folkways reserves the right to interpret, implement, and enforce these rules at any time and may amend them as needed to ensure a safe, well-produced, and high-quality event experience.

About Night Bazaar
Statement of Purpose
Night Bazaar is a curated evening market produced by Folkways that celebrates local arts, culture, and creative entrepreneurship in downtown Fargo and surrounding venues.
Broadway Square events transform 2nd Avenue into a pedestrian-only marketplace where vendors line the street and guests move freely between booths, live performances, and interactive experiences. Night Bazaar typically features 50–60 vendors and welcomes thousands of attendees throughout the evening.
Additional events may take place at venues such as Brewhalla or in Moorhead, Minnesota, each adapted to fit the space while maintaining the signature Night Bazaar experience.
Night Bazaar prioritizes creative vendors, strong visual presentation, and an engaging customer experience. Vendors selected for participation are expected to contribute to the overall aesthetic and energy of the event.

Admission of Vendors and Products
Application Process
Vendors interested in participating in Night Bazaar must complete the online application form available on the Folkways website.
Applications are reviewed by the Night Bazaar Review Committee. Approval is granted at the sole discretion of the Committee based on event needs, vendor fit, and overall event design.
Admissions decisions are informed by a standardized review process used by the Night Bazaar Review Committee to ensure fairness, consistency, and alignment with event priorities.
Submission of an application does not guarantee acceptance. Vendors may be accepted for one or multiple events depending on availability and alignment with event themes.
Admissions Considerations
Night Bazaar is a curated event. Admissions decisions are made to support a balanced, visually engaging, and high-quality experience.
Priority is given to:
Artists, makers, and creative entrepreneurs
Vendors whose products align with the theme of the event
Vendors who demonstrate strong booth presentation and customer engagement
Vendors who contribute to category diversity
Vendors in good standing from prior Night Bazaar events
Applicants are encouraged to provide detailed descriptions, photos of products, and images of booth setup. Incomplete applications may not be considered.
Prohibited Products
The following are not permitted at Night Bazaar:
Resale or direct marketing products
Products processed or sold under a brand name other than the vendor’s without prior approval
Live birds or live animals
Franchise or direct sales businesses
Electronics and related accessories
Political propaganda
Any product or item deemed inappropriate by Night Bazaar management
Night Bazaar reserves the right to restrict products that do not align with event standards or themes.
Vendor Requirements
Permits, Licenses, and Taxes
Vendors are solely responsible for complying with all applicable federal, state, and local laws and regulations governing the sale of their products.
All required permits and licenses must be obtained and maintained by the vendor. Vendors are responsible for understanding and confirming the regulatory requirements that apply to their products prior to the event. Night Bazaar does not verify product eligibility on behalf of vendors.
Failure to secure proper permitting or regulatory approval — including health department authorization — may result in removal from the event without refund.
Vendors are responsible for collecting and remitting all applicable sales taxes and must provide documentation if requested by management.
Additional temporary permits may be required for events held outside of North Dakota, including Moorhead, Minnesota. Vendors are responsible for securing any required out-of-state permits.
Hot food and beverage vendors are subject to review and inspection by Fargo Cass Public Health. For questions regarding eligibility or food safety requirements, contact the Fargo Cass Public Health Environmental Health Division at 701-476-6729.
Insurance
All vendors must carry a Commercial General Liability (CGL) Insurance policy listing Folkways Community as an Additional Insured with a minimum coverage of $1 million per occurrence and aggregate.
A valid Certificate of Insurance must be submitted prior to participation.
Failure to provide proof of insurance may result in removal from the event without refund.

Reporting
Vendors are required to complete a post-event survey including gross sales reporting within the stated deadline. Failure to submit required reporting may impact eligibility for future Night Bazaar events.
General Bazaar Rules
Daily Operations
Night Bazaar events officially begin at 5:00 PM.
Vendors must unload and remove vehicles from the event footprint at least one hour prior to the event start time. Booth setup may not begin until vehicles have been cleared from the event area.
All vendors must be fully set up and ready to sell by 4:45 PM.
Vendors arriving late may be denied participation or reassigned at the sole discretion of the Bazaar Manager. Comprehensive information on non-compliance consequences can be found in the Enforcement Policy.
Early breakdown is not permitted. Vendors must remain operational until the official event end time (10:00 PM for Broadway Square events; 9:00 PM for Brewhalla and Sunset events).
Vendors must fully break down tents and displays before retrieving vehicles for load-out.
For Broadway Square events, all vendors must fully vacate the street by 11:00 PM.
Weather Operations
For Broadway Square events, a cancellation decision due to severe weather will be made by 3:00 PM on event day. Vendors will be notified by email, and updates will be posted on Folkways platforms.
Severe weather may include thunderstorms, sustained high winds, or other unsafe conditions as determined by Night Bazaar management.
In sustained winds exceeding 20 mph, vendors must take down tents, even if properly weighted (minimum 25 lbs per leg). Sustained wind refers to a consistent wind speed measured over at least one minute and does not include short gusts.
Night Bazaar management reserves the right to require tents to be removed or operations adjusted in the interest of safety.
No refunds will be issued if a vendor chooses to cease operations due to weather conditions.
Night Bazaar operates rain or shine, and all enforcement policies remain in effect regardless of weather conditions. Any weather-related absences or early departures must be approved in advance and may be subject to fines or additional enforcement at the discretion of the Bazaar Manager.
Booth Assignment
Booth spaces are assigned by the Bazaar Manager and event team prior to each event. Placement is at the sole discretion of Night Bazaar management and will vary by event based on layout, vendor mix, and overall event design.
Booth locations are not permanent and may change from event to event.
Placement decisions consider factors including:
• Product assortment and category balance
• Customer traffic flow
• Visual cohesion and overall event aesthetics
• Electricity needs
• Event programming, performances, and activations
While placement requests may be submitted, specific locations cannot be guaranteed. Placement decisions are made to support the success of the event as a whole.
Cancellation Policy
Vendors who need to cancel or withdraw from a Night Bazaar event must notify the Bazaar Manager as soon as possible.
A minimum of 48 hours’ notice is required to avoid late cancellation fees. Cancellations made with less than 48 hours’ notice may be subject to fines as outlined in the Enforcement Policy.

Vendor Practices
All Night Bazaar vendors should represent themselves in an appropriate manner, dress and state of cleanliness. Shirt and shoes must be worn at all times.
Neither the vendor nor their representatives may be impaired by alcohol or marijuana or illegal substances any time while on the Bazaar premises, as determined by the Bazaar Manager.
All vendors agree to abide by fair business practices.
No smoking (including electronic cigarettes) by vendors is permitted. Move 100 feet away from the Bazaar to smoke. All vendors should wash their hands before returning to their booths.
No vendor is permitted to play music at their booths during the Night Bazaar events.
The Night Bazaar team is committed to maintaining a work environment that is free of discrimination. In keeping with this commitment, we will not tolerate unlawful harassment of our employees, vendors, vendor co-worker, or an external third party. Harassment or unwelcome conduct, whether verbal, physical or visual, that is based on a person’s race, color, national origin, religion, age, sex, gender, sexual orientation or disability is not allowed.

Single Booth - $80
Double Booth - $150
Electricity Fee - $20
Power usage must be approved by the Bazaar Manager prior to use.
Dependence on electricity may limit booth placement.
Charging of phones, computers, or tablets is not allowed due to the limited amount of electricity available.
Generators are not allowed.

Tents are not permitted at Brewhalla events.
Invoices are issued upon vendor acceptance and must be paid by the stated deadline to secure participation. Booth space is not confirmed until payment is received.
Vendor invoices are issued through Square. ACH (bank transfer) is the preferred payment method. Vendors who choose to pay via credit or debit card will be responsible for the associated processing fee reflected on their invoice. Encouraging ACH payments helps us keep overall vendor fees as affordable as possible.
All booth fees are non-refundable within 14 days of the scheduled event date.
All cancellations and refunds are subject to the Night Bazaar Cancellation Policy.

Vendors are responsible for providing all items needed for their display. Vendors must have:
Canopy (10' x 10' E-Z Up tent or similar
Canopy weights – minimum 25 lbs per tent leg
Table(s)
Table covering
Business name signage
Clearly visible pricing signage
Vendors requiring electricity must also bring:
Commercial-grade outdoor extension cord (minimum 50 feet recommended)
Commercial-grade outdoor splitter (if needed)
Failure to bring required equipment may result in enforcement action. See Enforcement Policy for details.

Shelving or display risers
Broom
Tape, scissors, pens, paper
Sufficient change
(Night Bazaar does not provide change for vendors)
Booth Conduct & Cleanup
Stall space is non-transferable and may not be shared without prior approval from the Bazaar Manager. All displays must remain within assigned booth boundaries and maintain a neat and professional appearance.
Vendors must clearly display their business name, item names, and prices. Signage should be visible from a reasonable distance.
“Hawking,” defined as calling attention to products in a loud or repetitive manner, may be restricted at the discretion of Night Bazaar management.
Vendors are responsible for leaving their booth space and surrounding area clean. All trash and debris must be removed and disposed of off-site. Vendors dumping water into sewer grates must ensure no debris is present that could cause blockage.

Night Bazaar is committed to minimizing environmental impact and operating as a landfill-free event whenever possible.
Allowed Disposable Materials:
Unbleached brown paper plates, boats, bowls, and napkins
Wooden or bamboo utensils
Brown paper bags
Clear recyclable #1 plastic cups (cold cups only)
Plastic lids and straws (currently permitted)
Plates, Bowls, Napkins, Silverware, To-go containers and clamshells, Hot Cups
Prohibited Disposable Materials:
Styrofoam or polystyrene
Bleached paper products (white plates, bags, napkins)
Compostable plastics (not compatible with local waste systems)
Plastic silverware
Recyclable plastics #1 (except cold cups), #2, #4, #5, #7
Plastic bags
Enforcement Policy
Submission of a Night Bazaar Vendor Application constitutes agreement to abide by all event rules and policies.
Violations of these guidelines may result in written warnings, fines, suspension, or removal from future Night Bazaar events at the discretion of management.
Enforcement structure:
• First violation – Written warning issued by the Bazaar Manager
• Second violation – Written warning and associated fine
• Third violation – Review meeting with the Bazaar Manager, which may result in removal from future events
Night Bazaar reserves the right to enforce policies as needed to maintain a safe, equitable, and professionally operated event.
Grievance Policy
Complaints must be submitted in writing to the Bazaar Manager.
All grievances will be reviewed by the Bazaar Manager in coordination with Folkways management. Night Bazaar will work in good faith to review and address concerns in a timely and structured manner.
Promotion & Sponsorship

Folkways will promote the bazaar and its vendors through the following marketing strategies:

Email Newsletter: 3,274 subscribers
Professional photography of vendors, booths, and products
Press releases and coverage for television, radio, and newspapers in the FM Metro area
Posters and flyers distributed in the FM Metro area
Advertisements on social media, local radio, newspapers, and digital sites
Facilitating appearances in local magazines and newspapers
Actively approaching local businesses and organizations to become bazaar sponsors
Sponsorship
Night Bazaar may feature event sponsors who support the production and growth of the event.
Sponsors may be permitted to display signage or share information during the event. All sponsors are vetted by Folkways and must adhere to Night Bazaar rules and operational standards.
Sponsorship presence is managed by Night Bazaar staff.
